1. Acceptance

The following provisions govern your use of SILVER LOCKSMITH
Please read these terms and conditions carefully before using https://silverlocksmiths.com.au Web Site and services. By using the https://silverlocksmiths.com.au Web Site and services, you agree to be bound by these Terms and Conditions which constitute a contract between you and Silver Locksmith (ABN 94513284622) This company owns the website and operates the business known as “Silver Locksmith “. If you do not agree to all the provisions contained in these Terms and Conditions, DO NOT use the https://silverlocksmiths.com.au Web Site. We reserve the right to revise and update these Terms and Conditions at any time. Your continued use of the https://silverlocksmiths.com.au Web Site constitutes your acceptance of and agreement to any revised Terms and Conditions.

2. Price and Payment

2.1 At Silver Locksmith the Price shall be either:
(a) as indicated on any invoice provided by Silver Locksmith to the Customer; or
(b) Silver Locksmith quoted price (subject to clause 2.2) which will be valid for the period stated in the quotation or otherwise for
a period of Sixty (60) days.

2.2 Silver Locksmith reserves the right to change the Price if a variation to Silver Locksmith quotation is requested. Any variation from the plan of
scheduled works or specifications (including, but not limited to, any variation as a result of additional works required due to hidden or unidentifiable difficulties such as the site is unprepared for installation or as a result of increases to Silver Locksmith in the cost of materials and labour) will be charged for on the basis of Silver Locksmith quotation and will be shown as variations on the invoice. Payment for all variations must be made in full at their time of completion.

2.3 At Silver Locksmith a deposit may be required.

2.4 Time for payment for the Goods being of the essence, the Price will be payable by the Customer on the date/s determined by Silver Locksmith, which may be:

(a) on delivery/completion of the Goods;
(b) by way of instalments/progress payments in accordance with Silver Locksmith payment schedule;
(c) the date specified on any invoice or other form as being the date for payment.

2.5 Payment may be made by cash, cheque, bank cheque, electronic/on-line banking, credit card (plus a surcharge of up to five percent (5%) of the Price), or by any other method as agreed to between the Customer and Silver Locksmith.

2.6 There will not be a GST charge on Silver Locksmith Invoices.

3. Access

The Customer shall ensure that Silver Locksmith has clear and free access to the work site at all times to enable them to undertake the works. Silver Locksmith shall not be liable for any loss or damage to the site (including, without limitation, damage to pathways, driveways and concreted or paved or grassed areas) unless due to the negligence of Silver Locksmith.

4. Title

4.1 Silver Locksmith and the Customer agree that ownership of the Goods shall not pass until:

(a) the Customer has paid Silver Locksmith all amounts owing to Silver Locksmith; and
(b) the Customer has met all of its other obligations to Silver Locksmith.
4.2 Receipt by Silver Locksmith of any form of payment other than cash shall not be deemed to be payment until that form of payment has been honoured, cleared or recognised.

5. Defects, Warranties and Returns

5.1 The Customer must inspect the Goods and must within seven (7) days of receiving the goods notify Silver Locksmith in writing of any evident defect/damage, shortage in quantity, or failure to comply with the description or quote. The Customer must notify any other alleged defect in the Goods as soon as reasonably possible after any such defect becomes evident. Upon such notification, the Customer must allow Silver Locksmith to inspect the Goods.

5.2 If Silver Locksmith is required to replace the Goods, but is unable to do so, Silver Locksmith may refund any money the Customer has paid for the Goods.

5.3 Silver Locksmith may in its absolute discretion accept non-defective Goods for return in which case Silver Locksmith may require the Customer to pay handling fees of up to forty-five percent (45%) of the value of the returned Goods plus any freight costs.

6. Privacy

6.1 The Customer agrees for Silver Locksmith to obtain from a credit reporting agency a credit report containing personal credit information about the Customer in relation to credit provided by Silver Locksmith.

15.2 The Customer agrees that Silver Locksmith may exchange information about the Customer with those credit providers either named as trade referees by the Customer or named in a consumer credit report issued by a credit reporting agency for the following purposes:

(a) to assess an application by the Customer; and/or
(b) to notify other credit providers of a default by the Customer; and/or
(c) to assess the creditworthiness of the Customer.

7. All Cost that is listed on https://silverlocksmiths.com.au website is a minimum estimate for the job, the final cost will vary.

It will depend on the security level of the lock-system, The complexity of the job, programming cost if associated plus labour charges.
The final price will be explained before any work is done.
